The company's patent was upheld by the European Patent Office (EPO) in June 2006, a decision that was appealed by Anton Volpini de Maestri Packaging Enterprises L.C., the Austrian producer of Vinotop synthetic closures. Nomacorc and Volpini have reached a settlement and the appeal has been withdrawn. Nomacorc's patent is now in full effect in Europe.
